Leave as a partner

The paternity leave for salaried partners is once the number of working hours per week. As of  July 1st 2020, an additional paternity leave has been added. Paternity leave is also referred to as maternity leave, birth leave or partner leave.

Birth leave: once off for 1 week

Since 1 January 2019, partners have been given birth leave once the number of working hours per week. For example, you work 6 hours a day for 5 days. Then you get 30 hours of leave. During this leave your employer continues to pay the wages in full. You can take the days of your birth leave at your own discretion. But it has to be done within 4 weeks of the birth of the baby.

Additional birth leave from 1 July 2020: 5 weeks

As of July 1st 2020, partners can take an additional maternity leave for a maximum of 5 weeks (5 times the number of working hours per week). During your leave you will not receive a salary, but a benefit from the UWV. You can take the additional birth leave within 6 months after the birth of the baby. And you always should have taken the 1-week birth leave.

Accrual of vacation days and pension

The additional leave does not affect the accrual of (statutory minimum) holidays and holiday payment. It may be that the additional leave does affect the extra statutory accrual. This often includes agreements in the collective labor agreement and the employment contract. Pension agreements are not included in the law. The employer, employee and pension provider jointly make agreements about the accrual of the pension during the leave.

UWV benefit during additional birth leave

During your leave you will receive a benefit from the UWV. This benefit is a maximum of 70% of your daily salary (and a maximum of 70% of the maximum daily salary). The employer applies for the benefit with the UWV and pays the employees.
